1. Introduction

These Terms and Conditions govern participation in services, programmes, workshops, events, memberships, coaching sessions, breathwork sessions, retreats and activities delivered by The Phoenix Movement CIC ("The Organisation", "we", "our", "us").

By booking, purchasing or participating in any service, you agree to these Terms and Conditions.

2. Nature of Our Services

The Phoenix Movement CIC provides wellbeing, personal development, coaching, breathwork, educational and community-based services.

Our services are designed to support personal growth, emotional wellbeing, self-awareness and nervous system regulation.

Our services are not intended to diagnose, treat, cure or prevent any medical, psychiatric or psychological condition.

3. Important Medical Disclaimer

Content shared through our website, social media platforms, workshops, coaching sessions, breathwork sessions, retreats, programmes and educational materials is provided for informational and educational purposes only.

It is not intended as medical advice and should not be used as a substitute for professional medical diagnosis, treatment or advice.

Participants should always seek advice from an appropriately qualified healthcare professional regarding any medical concerns.

Do not disregard, delay or avoid seeking medical advice based on information provided by The Phoenix Movement CIC.

Do not stop, start or alter any medication or treatment plan without consulting your healthcare provider.

4. Coaching Disclaimer

Coaching is a collaborative process intended to support personal and professional development.

Coaching is not counselling, psychotherapy, psychiatric treatment, crisis intervention or medical care.

Participants remain fully responsible for their own decisions, actions, wellbeing and outcomes.

The Phoenix Movement CIC does not guarantee specific results from coaching services.

5. Breathwork Disclaimer

Breathwork may involve physical, emotional or psychological responses.

Participants acknowledge that they are voluntarily engaging in breathwork activities and accept responsibility for monitoring their own wellbeing throughout.

Breathwork may not be suitable for everyone.

Participants should seek medical advice before participating if they have concerns regarding:

  • Cardiovascular conditions
  • Respiratory conditions
  • Epilepsy or seizure disorders
  • Pregnancy
  • Recent surgery
  • Severe mental health conditions
  • Any medical condition that may be affected by intensive breathing practices

Participants agree to disclose relevant health information where requested.

The Phoenix Movement CIC reserves the right to refuse participation where it is believed participation may pose a risk to health or safety.

6. Participant Responsibility

Participants are responsible for:

  • Providing accurate information
  • Informing facilitators of relevant health concerns
  • Working within their own physical and emotional limits
  • Seeking professional support where required
  • Making informed decisions regarding participation

Participants are encouraged to stop any exercise or activity that causes discomfort, distress or concern.

7. Bookings and Payments

Payment is required in advance unless otherwise agreed.

Places may not be secured until payment has been received.

Prices may be amended at any time but changes will not affect confirmed bookings.

8. Cancellations, Refunds and Withdrawal Rights

8.1 Your Statutory Right to Withdraw (UK and EU/EEA Consumers)

If you are a consumer based in the UK or the EU/EEA, you have a legal right to withdraw from most bookings made online or at a distance within 14 days, without giving a reason. For coaching sessions and other services, this 14-day period runs from the date you enter into the agreement with us.

To withdraw, simply notify us in writing (email is fine) within the 14-day period. Where applicable, we will refund what you have paid within 14 days of being notified, using the same payment method you used to pay, unless otherwise agreed.

This statutory right sits alongside, and does not replace, the specific cancellation terms set out below for coaching sessions, workshops, events and retreats.

8.2 Digital Content and Immediate Access

Some of our materials, workbooks, recordings and programmes are delivered digitally and immediately upon purchase. By agreeing to these Terms and requesting immediate access, you confirm the following:

"I request immediate access to this digital content and I understand that, by doing so, I give up my right to withdraw once download or streaming access has begun."

If this confirmation is not given, your standard 14-day right of withdrawal described in clause 8.1 continues to apply, even where content has already been accessed.

8.3 Coaching Sessions Starting Within the Withdrawal Period

Where you ask for coaching to begin before the 14-day withdrawal period referred to in clause 8.1 has ended, you confirm the following:

"I request that my coaching session(s) begin before the end of the 14-day withdrawal period, and I understand that if I withdraw after service has started, I may be charged a reasonable amount for the portion already provided."

If you withdraw after a coaching session has started under this clause, you will be refunded for any part of the service not yet delivered, less a reasonable charge for the portion already provided.

8.4 Coaching Session Cancellations, Missed Sessions and Notice

  • More than 24 hours' notice: the session may be rescheduled at our discretion.
  • Less than 24 hours' notice, or a missed ("no-show") session: the session is forfeited and billed in full, with no refund issued.

This clause applies regardless of whether the session was paid for personally by the participant or by a third party on the participant's behalf (see clause 8.5).

8.5 Sessions Paid for by a Sponsor or Third Party

Where coaching sessions, programmes or other services are paid for by a sponsor, employer, or other third party on behalf of a participant, the same cancellation and notice terms in clause 8.4 apply.

The paying party (whether the participant or their sponsor) remains responsible for the full session fee where a session is missed or cancelled with less than 24 hours' notice, regardless of whether the participant personally attends or authorises the cancellation.

We recommend sponsors and participants agree between themselves in advance how any such charges will be handled. Unless otherwise agreed in writing beforehand, The Phoenix Movement CIC will bill the party who made the original payment.

8.6 Workshops and Events

  • More than 14 days' notice: refund less any non-recoverable costs.
  • Less than 14 days' notice: refunds may not be available. Places may be transferred at our discretion.

8.7 Retreats

Specific retreat cancellation terms may apply and will be communicated at the point of booking.

8.8 Participants Outside the UK/EU/EEA

If you are booking from outside the UK or EU/EEA, the statutory right described in clause 8.1 may not automatically apply to you. As a matter of our own policy, we aim to apply the same cancellation and notice terms set out in this clause 8 to all participants regardless of location. This does not replace any consumer protection rights you may separately have under the law of your own country.

9. Community Standards and Conduct

We are committed to maintaining safe, respectful and inclusive environments.

We reserve the right to remove any participant whose behaviour is deemed:

  • Abusive
  • Discriminatory
  • Harassing
  • Intimidating
  • Disruptive
  • Unsafe

No refund will be provided in these circumstances.

10. Confidentiality

Information shared within coaching sessions will be treated confidentially unless:

  • Consent is provided to share information;
  • Disclosure is required by law;
  • There are concerns regarding safeguarding, risk of harm or public safety.

Participants are expected to respect the confidentiality of others within group settings.

11. Photography and Media

Photographs, videos and recordings may occasionally be taken during events.

Separate consent will be sought before using images for promotional purposes.

Participants may withdraw consent at any time.

12. Intellectual Property

All materials, resources, recordings, workbooks, programmes, branding and content remain the intellectual property of The Phoenix Movement CIC unless otherwise stated.

Materials may not be copied, reproduced, distributed, sold or shared without written permission.

13. Limitation of Liability

Participation in any service is undertaken voluntarily.

To the fullest extent permitted by law, The Phoenix Movement CIC accepts no liability for any injury, loss, damage or adverse outcome arising from participation except where caused by proven negligence.

Nothing within these Terms excludes liability that cannot legally be excluded under UK law.

14. Accessibility and Inclusion

The Phoenix Movement CIC is committed to creating accessible and inclusive environments.

Participants are encouraged to inform us of any accessibility requirements so that reasonable adjustments can be considered.

15. Changes to Terms

These Terms and Conditions may be updated periodically.

The latest version will always be available upon request and through our website.
